Why use a Buyer Broker?

If your last real estate transaction was more than a few years ago, you were probably not represented by the agent you were working with!

With the advent of buyer representation and the removal of sub-agency, you, the Buyer, can become empowered through the use of an experienced Buyers Agent. The more experience your agent has, the higher the level of service you may expect.

The Bottom Line: What do you gain? Generally a savings in purchase price, a savings in loan costs, a savings in time, energy, and frustration, and usually a greater return on your real estate investment. (Make sure your representation is Fiduciary -- defined below!)

You need to be aware: Idaho passed a statute abrogating Common Law in July 1996. The effect of that change removed Fiduciary Representation from the standard practice of real estate in Idaho. Currently, real estate brokerages offering Fiduciary Representation in Idaho are rare! Most brokerages feel the liability is too great for most agents and have chosen to practice standard non-fiduciary representation in lieu of increasing liability.

The Bottom Line: As of July 1996 in Idaho, unless you have a signed buyer broker agreement with a real estate brokerage, you are not represented! In addition, if you desire your representation to be fiduciary, you must have a separate agreement in writing detailing what greater duties are being provided!

Note: If the agent you have been working with cannot explain these differences in representation, you have the right to seek an agent that can and will!
